The Non-Exclusive License

On our store, purchasing is simplified thanks to our unique license: all designs available in our catalogue are sold under a non-exclusive license, whether for personal use or for commercial production, without limitation of medium or territory and for a maximum period of 10 years. A design may therefore be purchased and used by several buyers (no exclusivity is granted to the buyer as a result of purchasing a design).

The purchased design may be used to:

create and resell physical objects on which the design is printed
create and resell digital content incorporating the design (in this case, the design may only be distributed in low resolution (72 dpi maximum) and in JPG format.

Buyers holding the license are authorised to adapt the colours and scale of the pattern where technically possible.

The duplication, resale, or sublicensing of all or part of the design is prohibited. The Design may not be purchased for resale as is. Likewise, the use of all or part of the elements comprising the design as a company logo or as a trademark is prohibited.

Pricing

The price of a design is determined by its size in cm (small, medium, and large). The price of the same design also varies depending on the type of file you choose to purchase: all designs are available in JPEG format, and most also offer an editable source file (vector .AI format or layered .PSD format) at a slightly higher price. All files are in high resolution (300 dpi).

The prices offered are therefore accessible to everyone, starting at €40 excluding VAT for the JPG.

Which file should you choose between JPEG and the source file (vector or Photoshop layers)?

By default, you will receive a high-resolution JPEG file (300 DPI), and you can also choose the vector source file (.AI or .EPS) or the Photoshop layered format (.PSD) if it is offered for sale.

The advantage of choosing the source file is that you can then modify the colours of the design and its scale (especially to enlarge it while maintaining its quality, applicable to the Illustrator .AI format). Depending on the original size of the design, it can be very useful to enlarge it in order to adapt it to any medium and project. You will then simply need to save the source file in the desired format (for example: JPG format so that you can use it with an online printer, or .TIFF/.AI/.PSD format for a local printer who may prefer to use the source file for printing).

In summary, a JPG may be sufficient for online printing, but a .PSD or .AI source file allows for greater flexibility (modification of colours, scale, and flexibility for the printer).

What is copyright?

Copyright consists of a set of rights held by a creator or their successors in title over original creative works for which the creator can provide proof of the prior existence of their creation. It arises on the day the work is created.

The creator holds so-called economic rights, which constitute their rights to exploit the work, as well as so-called moral rights, which are attached to their person. The creator may transfer their economic rights to a third party in order to exploit the work, namely the right of representation, the right of reproduction, the right of adaptation, and the resale right. The creator retains their moral rights (the right to authorship of their work, the right of disclosure, the right of withdrawal or reconsideration, and the right to respect for the work).

The creator authorises the buyer to exercise their right of reproduction under certain conditions detailed in the non-exclusive license of Clear Model.

What is an exclusive usage license?

An exclusive license grants the licensee an exclusive right of use.

Advantages:

For the buyer: The buyer is the only person entitled to exercise the assigned right against their competitors for a given application, business sector, and territory.
For the designer: An exclusive usage license allows the designer to sell their design at a higher price, which may be supplemented by royalties received on each sale.

Disadvantages:

For the buyer: The acquisition cost for the buyer is higher (an average of €500 or more for an all-over design in 2023 – according to our survey).
For the designer: The designer can no longer resell the design in the business sectors and territories used by the client.

What is a non-exclusive usage license?

A license is non-exclusive when the right of use can be granted to several clients. In other words, a design sold under a non-exclusive usage license may be purchased and used by several buyers, for the business sectors and territories defined by the license.

Advantages:

For the buyer: The acquisition cost is lower. On French Design, designs are sold at accessible prices starting from €40 excluding VAT (price varies depending on the size of the design).
For the designer: A non-exclusive usage license allows the designer to sell to a multitude of clients, reaching a wider market and thereby generating greater potential revenue. This model on French Design also offers greater flexibility to the designer while reducing marketing costs (no upfront costs to find new clients). Finally, French Design provides a solution that promotes the reuse of unsold designs (on average, 25% of the designs created each season are sold as one-shot designs for exclusive use. Unfortunately, most of the remaining 75% are lost forever – Survey).

Disadvantages:

For the buyer: The buyer is not the only person holding the assigned rights and may find the same design being used by one of their competitors.
For the designer: Once their design has been purchased under a non-exclusive license, they can no longer resell this design under an exclusive license.

The difference between a partial and a total usage license

A usage license, whether exclusive or non-exclusive, may be partial or total.

A partial usage license for a design includes a limitation in terms of territory, duration, and/or business sector.

A total usage license for a design does not include any specific limitation.

For example, a partial exclusive usage license is a license that grants the buyer an exclusive right to use the design (they are the only person who can purchase and use it) for a given territory (for example: for sales in Europe only) or for a given business sector (for example: use of the design exclusively in the home linen sector).

Conversely, a total non-exclusive usage license is a license that grants the buyer a non-exclusive right to use the design (they are not the only person who can purchase and use it) without any limitation in terms of territory and/or business sector (for example: the buyer may use the design, in accordance with the rights granted, in the home linen sector, in the women's fashion sector, and also in the stationery sector).
